APPLICATION FOR RETIREMENT PENSION

ARTICLE 123 :
(1). Admission to retirement marks the normal end of the civil servant's career and entitles him/her to a pension paid by the Treasury or any other pension fund under the conditions laid down by decree of the President of the Republic.
(2). It occurs :
- automatically, when the civil servant reaches the age limit, regardless of the administrative function he or she may perform by virtue of an individual or collective act, subject to the provisions of the special or particular statutes ;
- or by anticipation.
ARTICLE 124 :
(1). The age limit for retirement of the civil servant is fixed for each category as follows ;
a) category C and D : 55 years old;
b) category A and B : 60 years old.
(2). However, because of the nature or specificity of certain functions, the President of the Republic may derogate from the provisions of (1) above.
(3). The number of years of pensionable service for the calculation of the pension must correspond to the number of years of actual service as a civil servant.
ARTICLE 125 :
(1). A civil servant who has completed at least (15) years of service may be retired early at his request.
(2). A worker who, on leaving the service for any reason whatsoever, is not entitled to a retirement pension, is entitled to an immediate refund of all deductions made from his salary in respect of pension contributions during his career.
ARTICLE 126 :
The admission to retirement of the civil servant is pronounced by order of the Minister of Public Service.
This order liquidates the pension rights of the retired civil cervant.
